Nothing on this site is an offer

The service pages describe the kind of work we do and how we normally price it. They are not a quote, a bid, or a promise to take on any particular job. A price only exists once we have sent you a written scope for your site, and it only holds for what that document actually says.

Sending the quote form does not create a contract and does not reserve a date. It starts a conversation. We are free to decline any job, and you are free to walk away at that stage without owing us anything.

The written scope wins

If anything on this website ever disagrees with the signed scope for your project, the signed scope is the one that counts. A web page is marketing. A scope is the agreement. That order does not change, and nobody at this company can change it verbally on site.

We describe work, not conditions we cannot see

Earthwork depends on what is under the surface. Any description on this site assumes ordinary ground for the area. Rock, water, buried material, unmarked services and conditions that only appear once the ground is open can change both the price and the method. Where that is a real risk we spell it out in the written scope rather than here, because that is where it has to be enforceable.

What we take on

We are an earthwork and site preparation company. Where a job needs a trade we are not licensed or certified for, we say so and we do not take that part on, even if it would be easy to. Everything described on this site is work we do today. Nothing on this site is a statement about work we might add later.

Permits, marking and approvals

Unless a written scope says otherwise, permits and approvals are the property owner's responsibility, and so is having the site marked by Dig Safe 811 before we break ground. We will tell you when something needs a permit, and we will not open ground on an unmarked site. That is not a preference, it is how the work is done safely and lawfully.

Registration

Rhode Island requires a contractor's registration number to appear on advertising, proposals, contracts and invoices, in a conspicuous place. That is R.I. Gen. Laws § 5-65-22, enforced by the Rhode Island Contractors' Registration and Licensing Board. This website counts as advertising, so the number belongs here and in the footer of every page.

Accuracy of this site

We keep these pages correct and we fix them when they are not. We do not guarantee that every page is complete or current at the moment you read it. Photographs show work of the kind described, not a promise that your site will look the same.

Links to other sites

This site links to the Rhode Island Department of State so you can verify our registration. We do not control that site, we do not endorse anything else you may find there, and we are not responsible for it.

Content on this site

The text, drawings and layout of this site belong to ZD Veterans Construction LLC. You are welcome to quote a passage with a link back. Please do not copy pages wholesale, reuse our drawings, or present our work as your own.

Limits

This website is provided as it is, without any warranty that it will be uninterrupted, error free, or fit for a particular purpose. We are not liable for a decision made purely on the strength of a page here rather than on a written scope, and we are not liable for indirect or consequential loss arising out of using this website.

None of that touches the work itself. Our responsibility for a job we actually take on is set by the written scope for that job and by Rhode Island law, and nothing on this page reduces it.

Nothing in these terms limits liability where the law does not allow it to be limited, including liability for death or personal injury caused by negligence, and for fraud.

If part of this does not hold

If any part of these terms turns out to be unenforceable, the rest still stands. The part that fails is treated as narrowed to whatever the law does allow, rather than taking the whole page down with it.

Which law applies, and where

These terms are governed by the law of the State of Rhode Island, without regard to its conflict of law rules. If a dispute about this website ever has to go in front of a judge, it goes to a state or federal court sitting in Rhode Island, and both sides agree to that court hearing it.

There is no arbitration clause on this page, and that is deliberate. If you are a homeowner and something goes wrong, you keep every route the state gives you, including bringing a claim to the Rhode Island Contractors' Registration and Licensing Board. Nothing here signs that away, and nothing here asks you to give up the right to be part of a group action.

Before any of that: call us. Most of it gets sorted out in one conversation on site, and that is cheaper and faster for both of us than anything with a filing fee.

Changes to these terms

We update this page when the site or the business changes, and the date at the top moves with it. Changes apply from the day they are posted. They never change a scope that is already signed.
